07 25 18 PC Public Hearing - REVISED NOTICE

The City of Tracy Planning Commission will conduct Public Hearings on Wednesday, July 25, 2018, at 7:00 p.m., or as soon after as possible, in the Tracy City Council Chambers, 333 Civic Center Plaza, Tracy, to consider to the following:

Conditional Use Permit and Development Review Permit Application Numbers CUP17-0004 and D17-0010: Valero Service Station Remodel and Expansion at 153 E. Eleventh Street – Applicant and Property Owner is Raman Bains for BFS Tracy, Inc. – The proposal is a remodel and expansion of the existing Valero gasoline service station consisting of the removal of existing retail kiosk and storage structures, relocation of three fuel dispensers, relocation and remodel of the fueling canopy, construction of an approximately 1,425 sq. ft. convenience store building, and construction of associated modifications to the parking area. The project is categorically exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Section 15332 pertaining to in-fill development projects. Application Numbers TSM18-0001 and D18-0007: The Applicant is Brookview West Properties and the Property Owner is JB Land Holdings LLC – Public hearing to consider applications to approve a Tentative Subdivision Map and Development Review for 22 single-family lots on the 5.6-acre site. The site is located at 4005 S. Tracy Boulevard (the former Episcopal Church site), on the west side of S. Tracy Boulevard, south of Sycamore Parkway, and north of Whispering Wind Drive, Assessor’s Parcel Number 244-020-03. The project is consistent with the density established by the property’s existing Zoning and General Plan designations. Therefore, in accordance with California Environmental Quality Act (CEQA) Guidelines Section 15183, the project does not require additional CEQA analysis. Amendments to Section 10.08.3196 of the Tracy Municipal Code to Establish Zoning and Locational Requirements for Cannabis Non-Storefront Retailers – The Tracy City Council directed staff to draft ordinances and regulations to allow up to two cannabis non-storefront (delivery only) retailers to operate in the City. Staff have prepared two ordinances: (1) an amendment to Chapter 6.36 of the Tracy Municipal Code (TMC) and (2) an amendment to Section 10.08.3196 of the TMC, as well as regulations. These proposed ordinances and regulations would create a regulatory permitting scheme for cannabis businesses and cannabis business employees. The amendment to Section 10.08.3196 would establish zoning and locational requirements for cannabis delivery only retailers that would make them conditional uses in certain industrial areas in the City.

Staff will be presenting both proposed ordinances and regulations; however, the Planning Commission will only be making recommendations to Council regarding the proposed zoning amendment to Section 10.08.3196. The project is exempt from the California Environmental Quality Act (CEQA) pursuant to Business and Professions Code Section 26055(h), which provides that CEQA does not apply to the adoption of an ordinance, rule, or regulation that requires discretionary review and approval of permits or other authorizations to engage in commercial cannabis activity. This project is further exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), which provides that CEQA only applies to projects that have the potential for causing a significant effect on the environment. As this is only a series of text amendments and additions, it can be seen with certainty that there is no possibility that the ordinance would have a significant effect on the environment.
