City of Tracy Enforces Use and Sale of Illegal Fireworks

Safe and Sane Fireworks Legal within City Limits

The City of Tracy is enforcing the law related to the use or sale of illegal fireworks within the community. City officials are advising residents to abide by local law that allows for the purchase and discharge of Safe and Sane Fireworks. State law defines Safe and Sane Fireworks as any fireworks which do not come within the definition of “dangerous fireworks” or “exempt fireworks” (Health and Safety Code § 12529). Typically Safe and Sane Fireworks are those that do not leave the ground, do not send projectiles into the air or explode. Approved Safe and Sane Fireworks will always bear the seal of the State of California State Fire Marshal. Dangerous and illegal fireworks include but are not limited to the following: firecrackers, torpedoes, sky rockets, bottle rockets, shells, aerial bombs, flying spinners, and roman candles.

The sale or use of illegal fireworks is a violation of Section 12671 of the Health and Safety Code, and Chapter 3.04 of the Tracy Municipal Code. Violations can lead to misdemeanor charges that may result in up to one year in county jail and/or a fine of $1,000. Felony charges may lead to even greater fines and jail time, depending on the severity of the crime.

The Tracy Police Department will be enforcing violations of law related to fireworks and seeking prosecution through a cooperative effort with the San Joaquin County District Attorney’s Office. In this effort, the Tracy Police Department will be taking a “ZERO TOLERANCE” approach and deploying additional police officers leading up to and on July 4th for the specific purpose of enforcing violations of law related to the use of illegal fireworks.

The Tracy City Council approved an ordinance in 2011 permitting Safe and Sane Fireworks to be sold and used within Tracy city limits. Proceeds from the sales of Safe and Sane Fireworks benefit several local non-profit organizations that are selected through an annual lottery. After obtaining all necessary permits and completing the required safety training, the selected non-profits are permitted to sell within the City limits at the noted locations:

The sale of Safe and Sane Fireworks is only allowable within Tracy City limits from noon to 8 p.m. on June 28, 2017, from 8 a.m. to 8 p.m. June 29 through July 3, 2017, and from 8:00 a.m. to 9:00 p.m. on July 4th. The discharge of Safe and Sane Fireworks is permitted from noon to 10 p.m. from June 28 through July 3, 2017, and from noon to midnight on July 4th.

The discharge of any fireworks in unincorporated areas surrounding Tracy remains illegal and use is strictly enforced. Safe and Sane Fireworks are prohibited from sale and use within Tracy City limits as of 12:01 a.m. on July 5, 2017.

The Tracy Fire Department has several suggestions for keeping residents safe when using legal fireworks. First, do not let children light fireworks. Additionally, do not let children play with sparklers. Sparklers cause more injuries to children than any other type firework. Sparklers can burn at temperatures of about 2,000 degrees Fahrenheit, which is hot enough to melt some metals.

“Our primary concern is for the safety of our community. Your police and fire departments stress responsible use of safe and sane fireworks this season. The use of illegal fireworks will likely result in their confiscation and charges filed against the responsible party. Please consider the safety of your neighbors, their pets and our Veterans who may suffer from PTSD. We strongly encourage residents to attend the professional fireworks display sponsored by the Tracy Chamber of Commerce in lieu of using illegal fireworks,” stated Division Chief Dave Bramell.

In addition, the public should consider the following safety precautions when handling safe and sane fireworks: keep a water source within 100 feet of the fireworks discharge location, maintain a safe distance between fireworks and onlookers, position fireworks away from dry grass or other flammables, light fireworks one at a time, never point them in the direction of others, and discard used fireworks into a bucket of water.

The public is asked to report the use or possession of illegal fireworks to the non-emergency telephone number of the Tracy Police Department at (209) 831-6550. Residents may also report more serious issues, such as the sale of illegal fireworks, to Tracy Crime Stoppers at (209) 831-4847. Crime Stoppers may reward you for information that leads to the arrest of someone feloniously selling or possessing illegal fireworks.
