CITY OF TRACY PLANNING COMMISSION
PUBLIC HEARING

The City of Tracy Planning Commission will conduct a Public Hearing on Wednesday, October 23, 2019, at 7:00 p.m. or as soon after as possible, in the Tracy City Council Chambers, 333 Civic Center Plaza, Tracy, to consider the following:

Tracy Assisted Living and Memory Care Facility: Development Review Application Number D19-0019 and Specific Plan Amendment SPA19-0003 – The Applicant is Robert Ashin, Summit Senior Living; the Property Owner is Triad Tracy II, L.P. The project is to construct an assisted living and memory care facility on a vacant, approximately 2.73-acre site at the northwest corner of Corral Hollow Road and Alegre Drive (Assessor’s Parcel Numbers 238-190-25 and -26). The proposal includes an amendment to the Residential Areas Specific Plan to permit assisted living and memory care facilities in the Specific Plan’s General Highway Commercial designation (the designation in which the subject property is located). The Development Review Permit for the new building is exempt from the California Environmental Quality Act pursuant to Guidelines Section 15332, which pertains to infill development on five acres or less. The Specific Plan Amendment does not increase the development density established by the City’s General Plan, and therefore, in accordance with CEQA Guidelines Section 15183, does not require additional environmental review. APL19-0002: Owners are Gabriel and Amalia Hernandez – 1881 Newport Court.
Appeal of the Revocation of a Home Occupation Permit for auto detailing, pursuant to violations of Tracy Municipal Code Section 10.08.4600. The Project Manager is Ana Contreras, Community Preservation Manager, (209) 831-6416, ana.contreras@cityoftracy.org.

A Kids Place Preschool: Development Review Application Number D19-0016 and Conditional Use Permit CUP19-0003 – The Applicant and Owner is Maria Carina Diaz De Barajas. The project is to remodel an existing single family residence into a childcare facility on an approximately one-acre site (Assessor’s Parcel Number 242-240-36). The facility will accommodate up to 100 children from ages two years to 12 years old and operate from 6:30am to 6:00pm, Monday through Friday. The Development Review Permit and Conditional Use Permit are categorically exempt from the California Environmental Quality Act, pursuant to Guidelines Section 15303, New Construction or Conversion of Small Structures. Amendments to Section 10.08.3196 of the Tracy Municipal Code (TMC) to Establish Zoning and Locational Requirements for Cannabis Activities – The Tracy City Council directed staff to develop various regulatory requirements for cannabis activities, including the location of such activities. The Planning Commission will consider an ordinance to amend Section 10.08.3196 of the TMC, which would establish zoning and location requirements for commercial and personal cannabis activities or uses. These zoning regulations, combined with an ordinance to be considered by the City Council later, will constitute the City’s cannabis regulations.

The project is exempt from the California Environmental Quality Act (CEQA) pursuant to Business and Professions Code Section 26055(h), which provides that CEQA does not apply to the adoption of an ordinance, rule, or regulation that requires discretionary review and approval of permits or other authorizations to engage in commercial cannabis activity. This project is further exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), which provides that CEQA only applies to projects that have the potential for causing a significant effect on the environment. As this is only a series of text amendments and additions, it can be seen with certainty that there is no possibility that the ordinance would have a significant effect on the environment.
